by Thomas Gaskell Shearman, A Treatise On The Law Of Negligence Vol 1 Of 3 Classic Reprint Book available in PDF, EPUB, Mobi Format. Download A Treatise On The Law Of Negligence Vol 1 Of 3 Classic Reprint books, Excerpt from A Treatise on the Law of Negligence, Vol. 1 of 3 It must be conceded that, in a scientific Code of civil law, there would be no separate chapter on Negligence, The very first definition of negligence shows that a strictly scientific arrangement of the law would call for a statement of rights and duties, rather than of the facts which show neglect to perform those duties or to respect those rights. Nevertheless, a great mass of judicial decisions had clustered themselves under the general title of Negli gence, long before this or any other book had been planned under that title; and the number of such cases is constantly increasing. In the preparation of the various editions of this book, not less than forty thousand reported cases have been examined, nearly all of which had a direct bearing upon some question of negligence. After throwing out thou sands of these, as obsolete or repetitions, there remain cases in these volumes, over of which are from reports published within the last ten years. We leave others to estimate the vast number of unreported cases which must have been tried within the same period. It is manifest that there is an enormous and increasing amount of such litigation, and that it demands treatment as, practically, a separate department of the law. There is much lamentation over the continual increase of negligence suits; and the courts have sometimes expressed impatience with it. Indeed, it has become quite common for judges to state, as the ground of deci sions, the necessity of restricting litigation. Reduced to plain English, this means the necessity of compelling the great majority of men and women to submit to injustice. Treatise On International Criminal Law

by Kai Ambos, Treatise On International Criminal Law Book available in PDF, EPUB, Mobi Format. Download Treatise On International Criminal Law books, Since the adoption of the Rome Statute of the International Criminal Court in 1998, international criminal law has rapidly grown in importance. This three-volume Treatise on International Criminal Law presents a foundational, systematic, consistent and comprehensive analysis of international criminal law. Taking into account the scholarly literature, not only sources written in English but also in French, German, Italian, Portuguese, and Spanish, the book draws on the author's extensive academic and practical work in international criminal law. This first volume addresses the foundations of international criminal law and the emerging general principles. It examines the history of the discipline and the concepts behind it. Looking at the sources of international criminal law, the book then moves to investigate the general structure of crime in international criminal law, and to address in detail the role played by the concept of individual criminal responsibility. The subjective requirements of criminal responsibility are examined, and also those defences that exclude such responsibility. The full three-volume treatise will address the entirety of international criminal law, re-stating and re-examining the fundamental principles upon which it rests, the manner it is enacted, and the key issues that are shaping its future. It will be essential reading for practitioners, scholars, and students of international criminal law alike.

Upon the same day, yet no fires had been communicated other than these upon this day from this engine that engines in good order, and carefully managed, seldom communicated. Fire to the adjacent grass and stubble and where it appeared that something was seen to be thrown out of the smoke-stack, and fall into the neighboring stubble, and almost immediately the stubble was in a blaze, and thereafter a piece of coal was found surrounded by ashes in the stubble, and apparently the remnant of a piece of coal six inches in diameter, which had been there burning; and where the conductor of the train, at the first station after pass ing these fires, telegraphed to the assistant superintendent of the road, that the en gine was setting the country on fire and where it appeared from the testimony of experts that where an engine starts a suc cession of fires, and others operated along the same road under similar circumstances of wind and weather do not start any, the difference can be reasonably accounted for only upon the supposition of defects in the construction, condition, or management of the engine doing the damage, it was held that a verdict finding negligence would be sustained, although several competent wit nesses who examined the engine at and shortly after the fire testified, that it was in perfect order, and supplied with the best appliances for preventing the escape of fire, and that the engineer was compe tent and careful, and he testified that he used all possible care and precautions to prevent the escape of sparks and fire upon that day; and although there was no direct testimony contradicting these witnesses, and that it was impossible for any one from the testimony to point out in what respect, if at all, the engine was defective, or out of order, or the engineer guilty of negligence.
